Laughing Moms – Mom of the Year Contest 2015

SUBMISSION TERMS

By submitting a photo and story for nomination, you agree to abide by these Submission Terms and decisions of Laughing Moms, LLC (“Laughing Moms”) and its designees, which shall be final and binding in all respects relating to this Contest.

WHO CAN SUBMIT: You must be at least 18 years of age and a legal resident of the fifty (50) United States, Puerto Rico, or the District of Columbia. Contest is void where prohibited by law. Contest is subject to all applicable federal, state and local laws.

HOW TO SUBMIT: Between 4/21/2015 and 5/7/2015 (“Submission Period”), watch the Laughing Moms rereleased “Mom of the Year” parody on their YouTube channel and subscribe to their channel.  Then share the video link on your Facebook and/or Twitter page to help share the contest with moms everywhere.  Tag @LaughingMoms and use hashtags #LaughingMoms #MomOfTheYear and #MOTY so we can see your post. Finally, email MOTY@laughingmoms.com with a photo of the mom you’re nominating (either yourself or someone else) and why you think she deserves to be Mom of the Year. Include your social media usernames in your email so we can know you shared the video.

You should have permission from the nominated mother to submit the photo of her. Laughing Moms will use select photos and stories to share on our website during the contest period. Making a Submission as part of this Contest does not guarantee that your Submission (or any Submission) will be included on the Laughing Moms website. All Submissions (if any) will be selected by the Laughing Moms, in their sole and absolute discretion.  Any Submission can be removed from the Laughing Moms website at any time and for any reason by the Laughing Moms.

If you do not have a Facebook or Twitter account, establishing an account is free. All terms apply. Your Twitter account must be set to “public” in order for your Submission to be considered. You can make your Twitter account “private” any time after the conclusion of the Contest.

SUBMISSION REQUIREMENTS:

•Submission must be your own work product or you must have permission from the individual who took the photo to submit it in connection with this Contest.

•Submission cannot contain images of any persons other than the nominated mother, unless she gives express written permission for pictures of her children to also be released, and has custody rights to do so.

•Professional photos will not be accepted.
PHOTO CONTENT RESTRICTIONS:
Submission may not contain, and you hereby represent and warrant that it does not contain, any content that:

•infringes upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity;

•is sexually explicit or suggestive; profane, inappropriate, obscene or offensive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; endorses any form of hate or hate group;

•promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may be unsafe or dangerous; promotes any particular political agenda or message;

•defames, misrepresents or contains disparaging remarks about the Laughing Moms, its products or services or other people or companies, including the Laughing Moms competitors;

•contains copyrighted materials owned by others (including music, lyrics, dialogue), without permission to the extent permission is necessary;

•contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;

•contains the names or images of any person, or otherwise identifies any person, including, without limitation, celebrities and/or other public or private figures, living or dead;

•communicates messages or images inconsistent with the positive images and/or good will with which the Laughing Moms wishes to associate; and/or

•violates any law, rule or regulation.
If any Submission contains any of the above prohibited content, as determined by the Laughing Moms in
its sole discretion, or for any other reason, Laughing Moms may remove the Submission.
NOTIFICATION: If your Submission is selected, you will be notified by a comment on your Submission or Direct Message or @mention. You and the nominated mother (if you are nominating someone besides yourself) may be required to execute a Liability and Publicity Release, within five (5) days of date of notification. Failure to respond to the notification within the time period indicated or to sign and return all requested documentation within the specified time period or noncompliance with these Submission Terms will result in disqualification.
GRANT OF RIGHTS: By making a Submission, you and the nominated mother agree and hereby grant to Laughing Moms and its designees, successors, licensees and assigns an unlimited, perpetual, irrevocable, assignable, royalty-free, fully paid-up license to reproduce, distribute, create derivative works of, edit, alter, post, combine with other materials, exploit and otherwise use the Submission, and all elements embodied therein, in whole or in part, together with your name, Facebook, and/or Twitter user name, the nominated mother’s name, and the biographical information and/or image (including, but not limited to, Facebook or Twitter profile photo) of you and/or nominated mother, in any manner and in any and all media now known or hereafter devised throughout the universe for any purpose whatsoever, including, without limitation, for commercial purposes, without compensation or notification to, or permission from, you or any third party. Without limiting the foregoing, you understand and agree that if your Submission is included on the Laughing Moms website or social media pages or any contest sponsor pages, you shall not receive any compensation. You agree that Released Parties (as defined below) are not responsible for any unauthorized use of Submissions by third parties. Released Parties do not guarantee use of any Submission.
If Selected as Mom of the Year or runner-up, if any runner-ups are chosen, you and the nominated mother (if someone besides yourself) agree to execute any necessary documents to perfect the transfer of all right, title and interest to Laughing Moms.
GENERAL CONDITIONS: By making a Submission, you and the nominated mother agree (a) to release, discharge, hold harmless and indemnify Laughing Moms, AdPlotter, Parents, Facebook, Inc., Twitter, Inc., any additional sponsors, and their respective parents, affiliates, subsidiaries,and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind (including, without limitation, arising from claims based upon copyright infringement, trademark infringement, invasion of privacy, defamation, or right of publicity) to persons, including death, or property resulting, in whole or in part, directly or indirectly, from your participation in the Contest and/or the use of any Submission by Laughing Moms or any other Released Party; and (b) to the use by Laughing Moms and its designees of your name, Facebook, and /or Twitter user name, the nominated mother’s name, the city and state of residence of you and/or the nominated mother, image and/or likeness (including, but not limited to, Facebook, or Twitter profile photo) of you and/or the nominated mother, for advertising, publicity, promotional and trade purposes in any and all media, now or hereafter known, in any manner, worldwide in perpetuity, without compensation or additional consents from you or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.

Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled Submissions or notifications; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the uploading of Submissions or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Submission Terms, as solely determined by Laughing Moms, will be disqualified. Laughing Moms reserves the right at its sole discretion to suspend, modify or terminate the Contest at any time and for any reason. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, Laughing Moms RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
